The Council of State stopped the sale of Asteras

By calling upon the constitutional ban on taking actions that deteriorate the living conditions and downgrade the residential environment, the Council of State said “no” to the renewal project in the area of Asteras Vouliagmenis in the peninsula of Mikro Kavourio.

Under its 15/2015 experts report, the 5th Department deemed the project of the Presidential decree for the approval of a special plan concerning the spatial development of a public real property for an area of 301,864.99 square meters in the district in question, the revision of the city plan and the establishment of the land use and the construction terms illegal.

The prediction concerning the construction of a large number of houses of 7.5 meters high (up to 100) in built-up and non-built-up areas of the Mikro Kavourio peninsula is a thorn in the judges’ sides, since such a prediction places a burden on the already permissible uses (tourism-recreation) and will forever transform the sensitive area of the peninsula to a residential area with joint uses.

The Council of State ruled that thus there comes a deterioration of the existent natural, cultural and residential environment of the area; they pronounced in majority that this deterioration is not justified for reasons of public interest.
