What the European Union pursuits is to close the holes in the legal systems of the state-members which result in the ‘erosion’ of the presumption of innocence; it intends to do so by commencing the enactment of a new directive, which in fact impedes the infringement of the fundamental right of the defendants by the state. The directive is intended for the enactment of a safety net so that the defendant cannot plead guilty before public or police authorities before there is trial and a decision for his innocence or guilt.
