"Compulsory Mediation" under Greek Law No 4512/2018

 

Articles 178 to 206 of Law 4512/2018 which was approved by the Greek Parliament in the evening of Monday, January 15, 2018, regulate mediation in civil and commercial matters. According to the Ministry of Justice, these provisions seek to lighten the heavy burden of the Greek justice system, but also to inform Greek citizens on Alternative Dispute Resolution Methods. The law includes a series of detailed provision on the contract, the process as well as the legal consequences of mediation, but also on the creation of a Central Mediation Committee, the qualifications and the reward of mediators. The most controversial provision is the one of article 182, according to which mediation is compulsory in seven (7) categories of private disputes, including family law disputes, compensation from car accidents, medical errors etc.
